FAQ – Who ensures the accessibility of public web sites?

1. What is the reference standard?

The Stanca Act (Act no. 4/2004) is the Italian standard that recognizes the right toaccess to computer services of persons with disabilities. It was updated in 2013 and 2018 to transpose the EU directive 2016/2102.

The The legislative decree of 27 may 2022, n. 82 transposing Directive (EU) 2019/882 – European Accessibility Act. Establishes accessibility criteria to products and digital services, which will become mandatory from June 28, 2025, and those placed on the market after that date.

2. Who is responsible?

Public Administrations (PA):

  • The executives must ensure that sites and app public to comply with the requirements of accessibility.
  • L’obligation publish Accessibility statement, which must containstatus of compliance, the results of the tests, technical, subjective, feedback mechanisms, and information on the ombudsman for Digital.
  • The non-compliance entails leadership, possible disciplinary measures, the nullity of the contracts and financial penalties.
  • L’AgID (Agency for Digital Italy) oversees the implementation of the regulations, provides models and guidelines, handles reports and apply sanctions.

Private sector (economic operators)

Responsibility falls on the subject that provides services to the public through a website or app.

Already today, the Stanca Act (art. 3-bis) obliges businesses with average turnover exceeding 500 million eurosif they offer services to the public via the web respect the accessibility requirements.

From 28 June 2025, the obligation extends to a wide audience of economic operators, on the basis of the d.lgs. 82/2022.

The penalties expect monetary fines (from 5,000 € to 40.000 €) and, in more severe cases, the the withdrawal or blocking of the digital services that do not conform.

3. Such as technical standards do you use?

The WCAG 2.1 Web Content Accessibility Guidelines () now represent the technical standard main.

The european standard EN 301 549, harmonised at EU level, integrates, and specifies the accessibility requirements for products and digital services.

4. Who supervises and enforces the sanctions?

AgID is theauthority control for the Public Administration and the private actors involved in digital public services. Receives reportsrequires adjustments and can have penalties.

For the implementation of the d.lgs. 82/2022:

The MIMIT (The ministry of Enterprises, and Made in Italy) it shall ensure the accessibility of digital products.

L’AgID remains competent for digital services.
