FAQ – the Rights of persons with disabilities on the job

1. People with disabilities have a right to work?

Yes. The The Italian constitution (art. 4 and art. 38) and the The UN convention on the rights of persons with disabilities (ratified by law 18/2009) recognize the right to work and the full inclusion.

2. What are the main laws that protect workers with disabilities?

  • Law 68/1999: the discipline of the targeted placement of persons with disabilities.

3. What is the targeted placement?

Yes. According to the Law 68/1999:

  • From 15 to 35 employees → 1 worker with a disability.
  • From 36 to 50 employees → 2 workers.
  • More than 50 employees → 7% of the labour force.

6. What is a reasonable accommodation?

Are changes and adaptations needed to enable the employee with a disability to do your jobfor example:

  • technological tools,
  • adaptation of the station,
  • flexible hours,
  • work mode by remote.

7. What permits and concessions granted to workers with disabilities?

  • Law 104/92, art. 33:
  • 3 days monthly allowance paid or 2 hours of daily permit
  • Special leave up to 2 years to assist a family member with severe disabilities.
  • Priority in the selection of the place of work and in the refusal to transfer without consent.

8. Persons with disabilities have the right to work in agile or smart working?

Yes, if the disability makes it difficult to work in the presenceyou can request flexible working arrangements (smart working, tele-working), in line with business needs.

9. What are the protections against discrimination?

The employer may not:

  • reject the assumption, for reasons related to the disability,
  • hinder career,
  • fire in a discriminatory manner.

10. Such incentives have companies that hire people with disabilities?
